During the past decade Dr. Seggev has participated in 22 cases in which his own research or the rebuttal of proffered studies has reached the deposition or trial stage. A vast majority of those cases concerned IP matters, covering such areas as:

  • Likelihood of confusion
  • Secondary meaning
  • Trade dress
  • Genericness
  • Dilution
  • Deceptive advertising

Additional cases concerned class certification and demand estimation for public services that require government licensing.

This volume of work led to 7 trial appearances and 18 depositions. Ninety percent of those cases involved original surveys and 23 percent consisted of rebuttals of surveys conducted by others.

Dr. Seggev’s litigation research has been divided roughly two-thirds for plaintiffs and one-third for defendants. No court has rejected any of his work or testimony.
